Are Prenuptial Agreements Legally Binding in the UK?
Prenups are not automatically binding on the Family Court in England and Wales. However, the court can give substantial or decisive weight to an agreement where both parties entered into it freely, with a full appreciation of its implications, unless it would be unfair in the circumstances to hold them to it.

Our fixed fee is designed for straightforward agreements. If additional legal work is required, your lawyer will discuss this with you before additional fees are incurred.
Prenups are not automatically binding on the Family Court in England and Wales. However, the court can give substantial or decisive weight to an agreement where both parties entered into it freely, with a full appreciation of its implications, unless it would be unfair in the circumstances to hold them to it. Appropriate financial disclosure, independent legal advice and sufficient time to consider the agreement are important safeguards. The fact that the agreement is prepared online does not, by itself, reduce the weight that may be given to it.
Most couples complete the questionnaire in an evening and have their independent lawyer calls shortly after that. Start to finish it is typically a matter of a few weeks, but it can be faster depending on how quickly you both want to move and how prepared you are.
We recommend completing and signing your prenup at least 28 days before your wedding. There is currently no statutory 28-day deadline in England and Wales, but completing the process well before the wedding helps demonstrate that both parties had sufficient time to consider the agreement and entered into it freely. If you are close to your wedding date, we may recommend completing a postnuptial agreement afterwards.
A prenuptial agreement is entered into in contemplation of marriage. If you do not marry, it generally does not take effect. If your plans change, speak to us about whether a cohabitation agreement or other arrangement may be more appropriate.
